יביע אומר לרב עובדיה יוסף, חלק ו', אבן העזר סימן י"ד, הערה כ', שבה הוא מתריע ומלין על כך שבית המשפט העליון בישראל (בג"ץ) נוטל לעצמו סמכות לקבוע הלכות בענייני אישות וגירושין, תחום השמור לבתי הדין הרבניים ולפוסקי ההלכה בלבד. הרב עובדיה יוסף טוען כי התערבות זו פוגעת בעצמאות הפסיקה ההלכתית ועלולה להוביל לתוצאות בלתי הלכתיות בענייני גיטין.

In Yabia Omer, vol. 6, Even Haezer siman 14, note 20, Rav Ovadia Yosef protests that Israel's Supreme Court (Bagatz) has taken upon itself authority to set halachic policy in matters of marriage and divorce, a domain he maintains belongs exclusively to the rabbinical courts and halachic decisors. Rav Ovadia argues that this judicial intervention undermines the independence of halachic rulings and risks producing outcomes in get matters that are not halachically sound.

Dans Yabia Omer, tome 6, Even HaEzer siman 14, note 20, le rav Ovadia Yossef dénonce le fait que la Cour suprême d'Israël (Bagatz) s'arroge le pouvoir de fixer la politique halakhique en matière de mariage et de divorce, un domaine qui, selon lui, relève exclusivement des tribunaux rabbiniques et des décisionnaires. Le rav Ovadia soutient que cette ingérence judiciaire porte atteinte à l'indépendance de la décision halakhique et risque de produire, en matière de guet, des résultats non conformes à la halakha.
